Historically, guilt was established by observed driving symptoms, such as weaving; administering field sobriety tests, such as a walking a straight line heel-to-toe or standing on one leg for 30 seconds; and the arresting officer’s subjective opinion of impairment. The officer must correctly perform the Field Sobriety Tests (FSTs) that are approved by the National Highway Transportation Safety Administration (NHTSA). There are only three FSTs approved by NHTSA. The US Department of Transportation explains the Field Sobriety Test as, “a battery of three tests administered and evaluated in a standardized manner to obtain validated indicators of impairment and establish probable cause for arrest.” Despite the considerable steps by the NHTSA to create standardized guidelines for the administration and scoring of field sobriety tests, some studies question the reliability of these tests, even when executed according to the guidelines. Starting with the introduction in Norway in 1936 of the world’s first per se law which made it an offense to drive with more than a specified amount of alcohol in the body, objective chemical tests have gradually supplanted the earlier purely judgmental ones. Limits for chemical tests are specific for blood alcohol concentration or concentration of alcohol in breath.

Revocation Investigation Packet

Screening health professional or a behavioral health technician. The behavioral health professional or technician must administer at least one standardardized test for measuring alcohol dependency or substance abuse. It is a face to face interview which last between 30 minutes and 3 hours.

Arizona MVD DUI Screening

Suspension is the temporary removal of your driving privilege. It is an action that may be taken after a review of your driving record. The suspension remains in effect until application for reinstatement is made. In addition to the reinstatement fee, you must pay the appropriate license application fee for your age group.

Each time you are convicted or forfeit bail for a moving traffic violation, points are assessed against your permanent driving record. If you accumulate 8 or more points in any 12-month period, you may be required to attend Traffic Survival School (TSS), or your driving privilege may be suspended up to 12 months. All convictions for red-light/stop-sign running, aggressive driving, moving violations resulting in death or serious injury, and the first moving violation for drivers under 18 years of age require successful completion of Traffic Survival School following assignment. Failure to successfully complete Traffic Survival School when ordered will result in the suspension of the person’s driving privilege.

Arizona MVD DUI Screening

Although laws vary by state, DUI or DWI is generally considered to be driving under the influence of intoxicating liquor or drugs. Most jurisdictions will prosecute DUI to the fullest extent of the law.   • Following conviction, all offenders receive a mandatory alcohol assessment/evaluation to determine the nature and extent of their alcohol problems. Assessment costs range from $24–$100 and are paid by the offender or the state, as decided by the court. The assessment is conducted at sentencing. The court does not take the results of the assessment into consideration in final sentencing.
  • Treatment for repeat offenders and high BAC drivers is mandatory on a 3rd offense. All offenders are required to attend alcohol education or treatment as recommended by the assessment.

    Arizona MVD DUI Screening

    In 2000, approximately 6,000 blood and urine samples were analyzed for alcohol as a part of routine DUI (Driving Under the Influence) screening. However, only 50 percent of the samples were also analyzed for the presence of drugs. A complete drug analysis of all blood and urine specimens submitted for DUI investigation is necessary to implement a comprehensive prevention program. In order to obtain a clear, complete profile of those arrested for DUI, the presence of common prescription medications, over-the-counter medications, and drugs of abuse/controlled substances must be identified. If given a DUI it is sometimes necessary to have an ignition interlock system that makes the car available to the driver. When an interlock system is installed the user must blow into the device everytime before starting the vehicle. A restricted licensing screening can be given to lessen the time of a suspended license and let the person drive to and from work.

    Arizona MVD DUI Screening

    Nearly every state has some form of court ordered alcohol or substance abuse counseling that is required for DUI offenders.  The rules for screening and counseling vary from state to state. The majority of states require first time and/or repeat offenders to enroll in some kind of substance abuse treatment program.  Such programs are usually part of probation or parole conditions.  To determine what level of counseling is appropriate for individual offenders, some state statutes also impose a mandatory substance abuse screening, a process oftendone prior to sentencing.

    Arizona MVD DUI Screening

    An Ignition Interlock Device is a breath analyzer on your vehicle that is electronically connected to the ignition. These devices, the SSI 1000, is about the size of a cellular phone. When you breathe into the unit for several seconds, it measures your breath alcohol level and compares it with predetermined limits. A DUI is a serious matter. While first-time offenders may have better luck than repeat offenders, few people can afford to deal with the consequences of being arrested for driving under the influence.     Alcohol Evaluation Arizona

    While there are a number of field sobriety tests that an individual suspected of driving under the influence may be asked to perform, the National Highway Traffic and Safety Administration has decided upon three standardized tests that should be utilized when an individual is stopped under suspicion of driving under the influence:
    o Horizontal Gaze Nystagmus (HGN);
    o The Walk and Turn;
    o The One Leg Stand;
